Bybus Brand, Ownership and Services

The Bybus and Businabox brands are part of Businabox Ltd. (hereinafter "Bybus", "Businabox Ltd", "we"). For more information on Businabox please visit www.businabox.io.

Under the Bybus and Businabox Ltd banners, Businabox operates internet-based platforms. These platforms may appear in multiple languages and as downloadable apps. Bybus services include the identifying, comparing and matching travel and transport related services, products and accommodation facilities for website users, as well as offering, where available, direct booking options. Businabox does not operate or provide transport or travel related services, nor own any entity that provides travel or transport related services shown and / or made available to be purchased on the Bybus website. These products and services are provided by third party providers. Businabox is an independent company registered in England.

Terms and Conditions of Use

These Terms and Conditions of Use ("T&Cs") govern the use of Bybus services, websites and mobile apps and form the basis for the usage agreement between Bybus and the user in conjunction with our Privacy Policy | bybus.to. Individual agreements between the user and Bybus, for example as part of a booking, will take precedence. Any other business terms and conditions in any jurisdiction that may be held by the user are not applicable. Any agreement or contract between Bybus website users and Bybus and / or Businabox Ltd shall be governed by and construed in accordance with the laws of England.

These T&Cs apply exclusively to Bybus services. Additionally, and separate to these T&Cs, the terms and conditions of each third-party provider will apply to any tickets and services offered by said providers (e.g. transport, accommodation or any other product). Furthermore, additional terms and conditions may apply to the third-party booking platforms to which a Bybus website user is forwarded or redirected. Bybus has no influence over and cannot be held responsible for terms and conditions or terms of use supplied by third-party providers.

Bybus Services - General

Bybus services are designed to allow fast and easy transport, travel and trip planning by providing relevant and filtered information, showing multiple transport options for comparison where available.

A legal relationship between you, the customer, and Bybus will arise only where we offer our own services against payment.

Travel services do not form part of the Bybus service. Travel services do form part of a separate contract agreed between you and the respective third party provider. Bybus acts as an intermediary or broker between you (a Bybus website user) and each third party. Bybus is, therefore, not responsible for the any service provided by a third party nor the manner in which the service is provided.

The Bybus Search engine for transport and travel services

Users searching for travel options are presented with a range of transport modes which may include and is not limited to train / rail, bus, coach, ferry, tram, air / plane. Additional options, such as walking, cycling, hire of scooters, bikes, cars and other relevant options may also be presented. Options presented are based on information provided by and made available by third party operators, service providers and booking platforms. We endeavour to present timely, relevant and accurate results to allow users to compare options such as price, journey time, comfort, geographic start and end points of a service. We also enable users to purchase travel tickets directly via our website for some of the search results, or be directed to operators’ websites where we are unable to retail those travel tickets directly. With information being provided by third parties, there may be instances where there is a discrepancy between the information presented and the information shown on a third party operator’s website. While we aim to have any changes to third party services automatically update our search results, we are unable to guarantee the results’ accuracy or completeness.

Booking tickets and other services or products via third party operators or providers

Users wishing to purchase travel tickets or services that are not available directly to be bought on the Bybus website may be directly redirected to a third party operator or providers’ website to complete a transaction. In these circumstances, a contract becomes formed between the third party operator or provider and the website user and the third party operator or provider’s terms and conditions apply. Bybus receives a small commission in such circumstances as we have acted as an intermediary. A user wishing to amend or cancel a booking would need to do so using the third party operator or provider’s website. The third party operator or provider may apply additional fees.

Booking directly on Bybus

Bybus offers secure online booking options directly on behalf of many third party travel and transport operators.

Bookings made directly on the Bybus website require the collection of data, such as email addresses and payment information in accordance with our Privacy Policy[SV1] . Completing a booking transaction on the Bybus website means that a booking confirmation will be emailed. The confirmation email includes documents for travel (normally a PDF file and / or mobile tickets with QR codes) and an invoice[SV2] and contractually confirms a contract for the service. Customers should check the travel documents upon receipt and contact Bybus in the event of any incorrect information. Bybus receives commission for bookings made over the Bybus website and may also levy a service or booking fee under these T&Cs.

Additional fees imposed by the respective third-party providers may also apply.

You are not generally entitled to a right of withdrawalas travel services, including online travel ticket bookings, are generally exempt from the United Kingdom Consumer Contracts Regulations 2013. 

Booking of transport and travel services directly can only be carried out using any payment method provided on Bybus.

When paying for a booking by credit or debit card, you expressly consent to the collection of the fee for the applicable travel service, any other ancillary items that may be made available for sale andany specified booking fee levied by our fulfilment partner or payment service provider, or from the credit or debit card provider. Should you choose to pay via PayPal, Google pay, Appley pay, any other payment service provider[SV4] online transfer (if possible), you will authorise the payment yourself.

In the unlikely event that you wish to cancel the transport or travel service booking and withdraw from the contract, the applicable terms and conditions and costs for cancellation will be based on the terms and conditions set out by the third-party operator(s) or provider(s), some of which may include a policy of not fully refunding cancellations. Henc, we will process cancellations for bookings made directly on the Bybus website either fully or partially where we are able to do so.

We assume no liability for the availability of the trip at the time of booking or for the fulfilment of the booked trip by a third-party operator(s) or provider(s).

Travel insurance

We may from time to time arrange travel insurance in several languages and countries as a license-free "annex intermediary"

The insurance offered is tailored to each specific booking request. The insurance contract is concluded directly between you and the insurer.

Registration

You can create an account with Bybus and can access your individual profile by entering your credentials (usually your email address and a password) or via a Google login. Your personal data and booking information will be handled in accordance with our Privacy Policy. Registered users must be legal adults and natural persons of full legal capacity. Registration cannot be transferred between users. A user must provide all required information in a complete and correct manner and, when necessary, provide updates.

Once registered, your account will be active for an indefinite period of time. The user and Bybus are entitled to terminate the account at any time by providing twenty one days' notice. The right to termination without notice for good cause is unaffected.

Intellectual property

We, our affiliates, providers, vendors (“Third Parties”) and other licensors own the Bybus.to service and all of the text, images, software, service marks, trademarks and other contents of the Bybus Service (“IP”). You agree not to copy, transmit or create derivatives of any of the IP, except for personal, non-commercial use on your computer or mobile device. Businabox, Bybus, the Bybus and Businabox logo and icons and Bybus.to and Businabox.io are trademarks or registered trademarks of Businabox Ltd. Other content, products, services, or commercial marks displayed throughout our service are the property of our affiliated Third Parties and other licensors. By accessing our service you are not granted any license or right to use any of the marks or content contained in the Bybus service.

Payments, Fees for third party services, transactions, bookings and card or other payment processing

A breakdown of the costs and fees that comprise the amount due for each booking, including fees charged by the third party Service Operator or Provider, is presented to users. You agree to pay, or authorise the payment for all such fees, together with any additional fees or costs as may be incurred by your credit card or payment service provider, if any. Your payment may only be made via the acceptable payment system(s) specified on the reservation booking page, whether that is on Bybus or on the third party operator or provider’s website.

When booking directly on Bybus, we may charge a booking fee for services provided to you under these Terms and Conditions of Use. The service fees vary and will be displayed at the time of booking. Please note that when using a foreign currency, foreign transaction fees may also apply. Please also note that Bybus Service Fees are non-refundable. This is because Our Fees are charged for the intermediation services, which are fulfilled when a transaction has completed, i.e. a booking has been confirmed to you.

We will also charge for additional fees for using certain payment methods as stated by the applicable laws, should we make those payment methods available i.e. if You use a corporate card or a tripartite system (American Express or Diners). These fees are non-refundable. Please note that Our systems automatically detect the payment method which is actually used along with any the corresponding additional fees. We offer a variety of payment options so that users have a choice and may seek to use a payment method that offers convenience and value, according to a user's preference.

Service Fees for changes or cancellations

We advise you to read and understand third party operators and providers’ terms and conditions before completing any booking. We also aim to inform you of the general terms and conditions when making a booking. Some third party operators and providers allow cancellations and / or refunds or to amend a booking and you may be able to cancel, amend or request a refund online or directly with the third-party provider.

You are very likely to need to pay for any difference in cost for your new ticket and any applicable fees determined by third-party providers. Bybus may charge you a fee for changes or cancellations for the service performed by us. Please note that our service fees do not include the amounts ultimately charged by third party operators and providers, according to their terms and conditions. Bybus and Businabox Ltd service fees are non-refundable.

Changes or cancellations processed by by Bybus are not guaranteed Bybus cannot guarantee that cancellation, amendment or refund requests will be processed as such requests are always subject to the terms and conditions of the corresponding third-party operator or provider, which may also set limits on the number of hours prior to a trip’s departure time that a booking may be cancelled, fully or partially refunded or amended. Note also that exchange rate fluctuations may impact the value of transactions made relating to cancellations, refunds and amendments. We update exchange rates regularly, though they may not exactly match real time market rates. Fraudulent tickets will not be changed, cancelled, refunded or replaced.

Limitations, liabilities, indemnity and User obligations and duties

Limitations

We make our website and its respective functions available to users; there is no entitlement to the provision of specific functions. Bybus makes no representations or warranties of any kind, express or implied, as to the operation of our site or the contents or services included on or otherwise made available to you through our site, unless otherwise specified in writing. We do not warrant that your use of our site will be free of error or uninterrupted. We do not guarantee the permanent availability of our site and technical problems that are outside of our control may lead to downtime. Downtime and limited availability may also occur during maintenance activity, when carried out. We do not warrant that our site or its server or servers are free of viruses or other harmful elements. It is important that you are protected against all viruses and software that could affect your device after using our website, apps or a third party operator or provider website. You agree expressly, by using our site, that you do so at your sole risk and that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with your use of our site.

We have the right to change the content or functionality of our site at any time such as through patches, updates or modifications. Proprietary rights and all other rights relating to this website belong to Bybus.

When using our site, you are not allowed to use any device or software or automatic scripts or routines to hack or attempt to interfere with our services or the security of our website or apps, or to create multiple accounts or to strip, scrape or mine data from any of our services. You also may not change or upload content (unless asked to do so as part of a transaction) on our website or attempt to use or use any tool, software, engine or other mechanism to navigate or use our services except for commercially available browsers or software to assist with accessibility).

Using any electronic means including and not limited to robots, scripts or other automatic devices to use our services or monitor or copy content pages is also not permitted, except where this is a normal activity using commercially available search engines.

Limited Liability of Bybus and Third Party Operators and Providers

We endeavour to make sure that information displayed on our website is accurate. When providing details on travel services and connections, we rely on the information conveyed to us by the relevant third-party providers. We are unable to fully verify or guarantee the accuracy or currency of the information that we gather and present. We carry out reviews on an ad-hoc basis. As a result, we ask that users please review the all travel details during the booking process and prior to authorising or making payment. We make no representations or warranties, nor can we provide our users any guarantee as to the accuracy, completeness or currency of the travel information. The same applies to all other information presented on our website that is or has been made available to us by and / or gathered from third-party providers.

We are not liable for the content of third-party offers or for any contracts concluded with third-party providers. We do not present or participate in the presentation or description of travel services on the websites of third party operators or providers.

When we act as an intermediary for and / or agent on behalf or third-party offers, we bear no responsibility for the availability of services or travel connections at the time of booking on third-party operator or provider websites. Nor do we bear responsibility for the delivery and satisfactory performance of services booked with third-party operators and providers. Neither we nor our affiliates make any representations or warranties with respect to the information, products, services or software provided on or contained within our website, in particular with regard to the suitability for a specific purpose, unless this has been expressly and individually agreed to with our users. Any warranty claims or claims for damages must be brought directly against the relevant third-party provider.

We are not liable for any interruption or interference in the availability of our website or services which has not been caused by us. We strive to ensure the faultless and continuous technical operation of our service. We cannot, however, assume any responsibility or liability for the uninterrupted and prompt accessibility or availability of our service. This applies in particular to technical delays and failures and any damages resulting therefrom.

Links to other sites that we do not operate or control and for which are not responsible are contained on our website. We do not endorse the content of these websites. We do not take any responsibility for the lawfulness or functionality of such content and are not liable for any loss or damage that may be caused by using such sites. We recommend that you carefully read the Terms of Use for each of these websites. Our own liability remains unaffected.

We act as an official agent on behalf of the third party operators and providers. As we do not provide the transport services, we are responsible for our service only.

You are financially liable for all bookings made directly with us, as well as any losses we incur if you breach the Terms and Conditions or misuse our booking service. This includes any scenario where you deliberately allow someone else to use your account to make a booking.

We are responsible for loss or damage only in the event that the loss or damage is foreseeable. Loss or damage is foreseeable only if it is obvious that it will happen or, at the time the contract was concluded, both Bybus and you knew it might occur. We are not responsible for losses you suffer that are not related to our booking service or for any delays or cancellations, including missed connections and / or other onward travel or accommodation bookings. For example, we are not liable to pay for costs associated with (and not limited to) hotel bookings, taxis, car hire or air fares or an event that you had to cancel as a result of a delay or cancellation relating to a transport service booked on Bybus or via a third party operator or provider’s website.

Should you be dissatisfied with our site or any materials on our site or with our T&Cs, your remedy is that you may discontinue using our site.

Duties and Obligations of the User, Advice

You as the user are responsible for ensuring that you comply with all formalities of travel (passport and visa requirements, entry requirements, customs and currency regulations, vaccination requirements and other health ordinances). To ensure that your journey runs smoothly, you must take note of any instructions and advice provided by tour operators and forwarded by Bybus.

Data Protection

You consent to the use of your information in accordance with our Privacy Policy when using our website and / or our mobile app The way in which we handle your data when you use our service is outlined in our Privacy Policy.

Changes to our Terms and Conditions of Use

We reserve the right to modify these terms and conditions at any time. Our service may evolve and expand at any time. The terms and conditions that were valid at the time of the most recent booking will apply for existing users, unless a notice of amendment was received beforehand.

Miscellaneous

The contractual relationship between Bybus and the user will be governed by English law, unless a different jurisdiction is applicable as per Law. Claims arising from consumer protection standards can be asserted by the user in accordance with English . The provisions of the United Nations Convention on Contracts for the International Sale of Goods dated 11 April 1980 shall not apply.

The exclusive place of jurisdiction is England, provided the user is a merchant or a legal person under public law. Bybus is headquartered in Manchester, England. Any additional mandatory places of jurisdiction for users classified as consumers, at their respective home or place of residence remain unaffected.
